Advancing the Start of Duty from the Rostered Time
- With effect from 1st September 1989, when an officer has completed a tour of duty on a particular force day and, without due notice, the starting time of his tour of duty on the force day immediately following is brought forward so that the tour of duty straddles the two force days concerned the time the officer is required to be at duty prior to the rostered start shall:-
- be paid at current overtime rate, and
- count in determining the hours worked on which to base the commencement of overtime
- With regard to due notice, the following shall apply:-
the officer should be given as much notice of the change as possible;
every effort should be made to ensure that notice is given before the end of the shift prior to the one that is to be altered
- The compensation set out in Paragraph I above is payable only in the circumstances described in that Paragraph, and where an officer is given notice less than 8 hours before the revised starting time.
- It is agreed that the circumstances set out in Paragraph I do not constitute a recall to duty as referred to in Police Regulations.
NOTES:
To properly examine the effect of advancing the start of duty from the rostered time, it is essential to go through the Circular which relates to Regulation22(7)(d) in some detail;
"when an Officer has completed a tour of duty on a particular force day"
This is important because had the officer not completed a tour of duty on that particular day then, by definition, that day would have been either a weekly rest day, public holiday or annual leave day which would attract different compensation.
"without due notice" - as much notice as is possible should always he given, this regulation applies, "where an officer is given notice less than 8 hours before the revised starting time".
"the tour of duty straddles the two force days concerned"
